You are preparing to prosecute a man who is accused of driving his car recklessly and hitting a woman riding a bicycle. The cyclist was injured as a result of the impact. To make things worse, the police report states that the driver of the car smelled strongly of alcohol at the time of the crash.

In your state, a person with a blood alcohol level (BAL) of 0.05 is considered legally impaired. They can be charged with driving while impaired (DWI).

The doctor's report says the driver had a BAL of 0.09 at the time of the accident. The cyclist suffered severe breaks and fractures to her fibula and tibia (bones in the leg). There were serious lacerations (cuts) to the tendons and connective tissues. According to the doctor, the cyclist will need a long period of rehabilitation.
