Real estate agents must have a solid understanding of the law. Contracts for selling and buying homes or property are legally binding documents, so real estate agents must be able to advise their clients on all the implications of the contract. Sometimes, however, things aren't always clear, and the agent will have to make a decision based on gut instinct.

You are helping a client find a new home. After a few days of looking, she chooses one of the houses you have shown her. The seller has not listed with an agent, but is prepared to take an offer on his home.

You approach the seller with your client's offer to purchase, and you explain the terms of the purchase to him. He accepts the offer and agrees to meet with you and your client to sign the contract. It's just a matter of signatures at this point, so the sale -- and your commission -- are in the bag.

When you arrive at the meeting, however, the seller informs you that he has hired a lawyer who will act as his real estate agent for the contract signing. This changes things. Instead of getting to keep the whole commission for the deal, this means you will have to split your commission with the lawyer.

Is it unfair of the seller to ask you to split your commission? You think it's unethical for a lawyer to accept a real estate commission. But you don't want to anger the seller and lose the deal for your client.
