You decide to refuse to split your commission.

This is the real-life decision made by Rick Neilson, a Utah real estate agent.

You tell the seller you will need some time to consider the situation before you agree to the contract. You investigate the lawyer and discover he has a reputation for working with private home sellers to rip off real estate agents. The lawyer was hired by the seller because they planned on splitting the half of the commission they took from you.

You report the lawyer to the state legal board and he is put on probation for his unethical legal practices. Once the seller realizes what has happened, he agrees to the sale of the house. The client gets the deal she wants and you get your full commission.

"It was a tough call," says Neilson. "I would gladly have split the commission with another agent, but this situation seemed awfully shady to me. It would have been easier to back down and accept half the commission, because it could have meant losing the deal and my client, but I'm glad I stuck it out."
